Terms of Use

Draft — must be reviewed by an Australian lawyer before relying on it.

Needs professional review. These terms are a starting draft, not legal advice, and do not make the site “legally covered”. Have them reviewed by a qualified Australian lawyer (and your insurer) before publishing, and complete the placeholders below.

1. About these terms

These Terms of Use govern your use of Sparkie Sidekick (the “site”), operated by Sparkie Sidekick (“we”, “us”). By using the site you agree to these terms. If you do not agree, do not use the site.

2. Educational purpose only

The site provides general educational information and fault-finding suggestions about electrical principles, components, testing and circuits. It is notprofessional, engineering, design, compliance or legal advice, and it is not a substitute for the current standards, manufacturer instructions, your site procedures, or a licensed person's judgement.

3. No DIY electrical work

Electrical work is restricted by law to licensed/qualified people in most of Australia. You must not use the site to attempt do-it-yourself electrical work, or any work you are not licensed, authorised and competent to do. See our Electrical Safety Disclaimer.

4. Your responsibilities

You are responsible for working safely and lawfully, for verifying all information against current standards (including AS/NZS 3000 and AS/NZS 3008), manufacturer data and local requirements, and for any decision you make using the site. You must not rely on the site as the sole basis for repair, energisation, commissioning, return-to-service or design decisions.

5. Acceptable use and prohibited use

You agree not to use the site to:

  • attempt or instruct unlicensed or unsafe electrical work;
  • bypass, defeat or disable safety devices, interlocks, overloads, guards, emergency stops or protection;
  • break the law, infringe others' rights, or harm anyone;
  • upload, copy or distribute copyrighted standards tables, proprietary manuals, or confidential site documents; or
  • misuse, disrupt, scrape or reverse-engineer the site.

6. Accounts

If you create an account, you are responsible for your login details and for activity on your account. Keep your password secure and tell us if you suspect unauthorised access. You can delete your account from your account settings.

7. Intellectual property

The site's original content, text, diagrams and code are owned by us or our licensors and are protected by law. You may use the site for your own learning and work reference, but you may not reproduce or redistribute it commercially without permission. The site is not an official source of any standard.

8. No warranties

The site is provided “as is” and “as available”, without warranties of any kind, including accuracy, completeness, fitness for a particular purpose, or that it is up to date. Calculator and fault-finding outputs are indicative only and not a compliance statement.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any loss, injury, death, damage or cost arising from use of, or reliance on, the site, including from incorrect interpretation, unverified decisions, or unsafe work. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Third-party links and changes

The site may link to third-party resources we do not control and are not responsible for. We may change, suspend or withdraw the site or these terms at any time; continued use means you accept the changes.

11. Governing law and contact

These terms are governed by the laws of Victoria, Australia. Questions about these terms: help@sparkiesidekick.com.

Needs professional review. The operator details above, the limitation-of-liability and consumer-law wording, and whether a business entity/ABN is needed should all be confirmed by an Australian lawyer.
